Welcome to Operation Calm. These Terms and Conditions ("Terms") govern your access to and use of the Operation Calm website and the purchase and use of our products. By accessing this website or purchasing from Operation Calm LLC ("Operation Calm," "we," "our," or "us"), you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or purchase our products.

1. About Operation Calm

Operation Calm LLC is a North Carolina registered limited liability company.

2. Intended use

Operation Calm Resilience Kits are designed to promote comfort, engagement, and moments of calm.

They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical, psychological, developmental, physical or mental health condition. They are not therapy tools.

Individual experiences may vary.

3. Age recommendation and adult supervision

The Operation Calm Resilience Kit is intended for individuals aged 6 years and older.

Children must always use the kit under the direct supervision of a responsible adult.

Parents, guardians and caregivers are responsible for determining whether each item is appropriate for the individual using it and for supervising its use at all times. Adult users are responsible for determining whether each item is appropriate for themselves.

4. Product safety

Your safety is important to us. Please read the following information carefully before using the Operation Calm Resilience Kit.

The Operation Calm Resilience Kit is created for individuals aged 6 years and older. It contains multiple individual items, including small components and packaging materials that may present a choking hazard. The kit is not suitable for children under the age of 6.

Adult supervision is required at all times when children are using the kit. Parents, guardians, and caregivers are responsible for determining whether each item is appropriate for the individual using it and for supervising its use at all times. Adult users are responsible for determining whether each item is appropriate for themselves.

All items included in the kit should be used only for their intended purpose.

No item in the Operation Calm Resilience Kit is edible or intended to be eaten, chewed, swallowed, or otherwise consumed. No item should be placed in the mouth.

The ear plugs are intended solely for insertion into the outer ear canal in accordance with the manufacturer's instructions. No other item included in the kit is intended to be inserted into the ears, nose, mouth, eyes, or any other part of the body.

Before each use, inspect all items for signs of damage, wear, or defects. Do not use any item that is damaged, broken, or otherwise unsafe. Damaged items should be discarded or replaced promptly. Do not modify, alter, cut, break apart, or misuse any item included in the kit.

Packaging materials, including plastic bags, should be kept away from children and disposed of appropriately after opening.

The Operation Calm Resilience Kit is designed as a supportive resource to encourage comfort, engagement, and moments of calm. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical, psychological, developmental, or mental or physical health condition. It is not a therapy tool. It is not a substitute for professional medical, psychological, or therapeutic advice or treatment.

Individual experiences may vary, and Operation Calm does not guarantee any particular outcome or benefit from the use of the kit.

By purchasing or using the Operation Calm Resilience Kit, you acknowledge that all items are used at your own risk and agree to exercise reasonable care and supervision while using the product.

To the fullest extent permitted by applicable law, Operation Calm LLC shall not be liable for any injury, loss, damage, cost, expense, or claim arising from or relating to:

  • use, misuse, abuse, alteration, or modification of the product;
  • failure to read or follow the instructions, warnings, or safety information provided;
  • lack of appropriate adult supervision;
  • use of damaged, worn, altered, or defective items;
  • use of the product for purposes other than its intended use;
  • use of any item in a manner inconsistent with the manufacturer's instructions;
  • any allergic reaction, sensitivity, or other individual response to materials contained within the kit;
  • failure to inspect the product before use or to discontinue use after damage is identified;
  • the acts or omissions of the user, parent, guardian, caregiver, or any third party; or
  • any use, handling, storage, transportation, maintenance, or disposal of the product that is inconsistent with these Terms, the accompanying instructions, or its intended purpose.

The foregoing examples are illustrative and not exhaustive. The limitations of liability contained in these Terms apply to the fullest extent permitted by applicable law, regardless of the theory of liability asserted.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

5. Travel and security

Our kits are assembled with travel in mind and contain no liquids.

However, airport security requirements, customs regulations, airline policies, and prohibited item lists vary between countries, airlines, and airports.

Customers are solely responsible for verifying that the contents of the kit comply with all applicable travel regulations before traveling.

Operation Calm cannot guarantee that every item will be permitted through every security checkpoint worldwide.

6. Orders

All orders are subject to acceptance and availability.

We reserve the right to refuse or cancel any order for reasons including, but not limited to:

  • suspected fraud;
  • pricing errors;
  • inventory shortages;
  • payment issues; or
  • suspected misuse of our website.

If payment has already been processed, any canceled order will be refunded.

7. Pricing

All prices are listed in U.S. Dollars (USD).

Prices may change without notice.

Applicable taxes and shipping charges are calculated separately at checkout.

8. Shipping and returns

Shipping and returns are governed by our separate Shipping Policy and Refund Policy, which form part of these Terms.

9. Intellectual property

All website content, including but not limited to logos, product names, photographs, illustrations, activity book content, written materials, graphics, videos, and downloadable resources are the property of Operation Calm LLC unless otherwise stated and are protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission from Operation Calm LLC.

10. User conduct

You agree not to:

Our total liability shall not exceed the amount paid for the product giving rise to the claim.
